The present document (Sales General Conditions) defines the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the Lamodeuse.com website, hereafter referred to as "the customer" and, on the other hand, the company La Modeuse SAS, with a registered capital of €108,000, whose head office is located at 5 Route du Môle 2-3, Bâtiment B24 - CE 209, 92637 Gennevilliers Cedex, registered in the Nanterre Trade and Companies Register under the number 532 393 105 and whose European Union identification number (EORI) is FR53239310500020, hereafter referred to as "Lamodeuse.com".

 

1. PRICE

 

The price of items sold on www.lamodeuse.com is indicated in euros, all taxes included, excluding shipping costs.

Lamodeuse.com reserves the right to modify its prices at any time and without notice. Items will be invoiced on the basis of the prices in effect at the time of order registration. They remain Lamodeuse.com properties until the order's full payment is received by Lamodeuse.com. This price is payable in entirety and in a single payment.

Despite the vigilance of Lamodeuse.com, it is possible that pricing errors may occur on the website for any reason (computer bug, manual error, technical error...). If orders have been placed at erroneous or obviously derisory prices, the orders will be canceled. Lamodeuse.com will then inform the customer concerned as soon as possible, so that he/she can, if he/she wishes, place his/her order at the correct price.



2. ORDER

 

Any order placed on lamodeuse.com implies adherence to these General Conditions. Any confirmation of order implies your full and complete adherence to these general conditions of sale, without exception or reservation.

The customer can order via the site www.lamodeuse.com, 24 hours a day, 7 days a week.

Lamodeuse.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order or who presents any form of risk in its eyes.

Any order implies acceptance of the prices and descriptions of the products available for sale. Lamodeuse.com commits to honor orders received on the website only within the limits of available stocks of products. In the event that one or more products ordered are not available, Lamodeuse.com will inform the customer as soon as possible and, if necessary, reimburse the customer within 14 days following the payment of the amount paid.

Lamodeuse.com draws the customer's attention to the fact that the photographs cannot ensure a perfect similarity with the product offered for sale, particularly with regard to colors. Differences may result from the difficulty of rendering colors, materials and patterns on the screen. These differences cannot be interpreted as defects of conformity and lead to the cancellation of the sale.

Once the order is validated, it is no longer possible for the customer to request a modification.


 

3. PAYMENT


Payment of orders on Lamodeuse.com can be by :

  • Credit card (CB, Visa, Mastercard)
  • PayPal
  • Google Pay
  • Gift Card / Voucher

 

By validating the payment, you confirm that the credit card/Paypal account/Google Pay account belongs to you or that you are the legitimate holder of the gift card or voucher. Credit cards are subject to validity checks and authorization from the card issuer. If the required payment authorization is not confirmed, we will not be held responsible for any delay or failure to deliver the order.

Lamodeuse.com does not accept payment by check. All checks mailed to us will be automatically rejected and destroyed.

 

4. SECURITY OF TRANSACTIONS

 

The confidentiality and security of data transmitted on the web and the site http://www.lamodeuse.com are ensured by the SSL (Secure Socket Layer) secure payment module.

 

IMPORTANT INFORMATION ON SECURITY OF PAYMENTS BY BANK CARD ON INTERNET 3D Secure :

 

The 3D Secure system, created in 2001 by the international issuers VISA and MASTERCARD, aims to strengthen the security of online payments.

 

 

The advantages of the 3D Secure system:

 

It consists in applying an additional control during your online purchases by inviting you to enter an authentication code or personal information (which varies according to the banks) in order to allow your bank to identify you and to validate the transaction. This system aims to reduce the risk of fraudulent use of your bank card because in case of loss or theft, for example, your card cannot be used against you without the above identification elements.

In concrete terms, to pay for an order on www.lamodeuse.com with 3D Secure :

1. Enter your credit card number, its validity date and the last 3 digits of the cryptogram on the back of your card.

2. You will then be automatically redirected to the secure page from your bank which will require you to enter an authentication code or to authenticate yourself on your banking application.

3. Once the code is validated, you will return to the web store which will confirm the payment validation.

What is my 3D Secure authentication code?

The 3D Secure authentication code varies from bank to bank. Some banks set one with you, others send you a code by text message or through an electronic box that they provide, each time you make an online payment. Your authentication can also consist in entering your birth date.

5. E-GIFT CARDS

 

With the purchase of E-Gift Cards, you agree to the following terms and conditions of use.

 

Purchase of an E-Gift Card:

Several pieces of information are required. You must:
- Have a customer/guest account on the Lamodeuse.com website
- Select a visual
- Choose an amount
- Fill in the name of the beneficiary and your name
- Choose between the two options "print myself" or "send by email"
- Leave a personalized message
- Add to cart

 

If all the elements are not filled in, you will not be able to add a gift card to your cart. Once all the elements are filled in, go to your shopping cart to proceed with the purchase.

 

Please note that promotional offers (Private Sales, Black Friday...) are not valid on E-Gift Cards.


Delivery : 

After checkout, the E-Gift Card is directly sent to the email address you provide.

E-mail delivery is free of charge. If you place an order for products requiring transporter delivery ,the general delivery conditions will apply. The amount of your E-Gift Card will not be counted, only the products that require a transporter will.

 

Usage:

Each E-Gift Card can be used in installments and can be supplemented, if necessary, by any other payment method. It is valid for a period of 12 months starting from its sending date by email. In order to use it, you just have to copy the provided code in your email and put it into your shopping cart, in the box "Discount voucher and E-Gift Card". It can be used on the entire www.lamodeuse.com website. The buyer is solely responsible for the discount code sent by email. If the buyer voluntarily or involuntarily discloses the E-Gift Card to someone other than the beneficiary, Lamodeuse.com cannot be held responsible.

 

After the e-gift card expires, any remaining balance will be lost.

 

Return :

You have 30 days to return the E-Gift Card starting the day it is sent to the beneficiary. For any refund, please contact customer service by email at contact@lamodeuse.com, if the E-Gift Card has not been used at all the corresponding amount will be credited to the payment method used for the purchase.

 

6. SHIPPING AND DELIVERY

 

All orders placed on Lamodeuse.com are prepared within 24 hours from Monday to Friday (excluding holidays), provided that payment has been validated. Orders placed on weekends and public holidays are processed the next business day.\

In exceptional periods (private sales, sales, Black Friday, holidays ...) this period may vary up to 72 hours.

In case of modification of an order after its validation (example: unavailability of a product, address error...), the preparation period may be extended.

The customer can choose between three transporters:

 

Colissimo :

 

Colissimo international:packages are delivered to your home within 3 to 4 days* from Monday to Saturday (excluding public holidays) in Spain. This delivery is charged at a fixed price of 9.99 € TTC. No signature is required. Your package will be delivered in a mailbox if its size matches.

Mondial Relay :

 

Mondial Relay:Packages are delivered to one of the 12,000 pick-up points in the Mondial Relay network in Spain within 5 to 7 days* (excluding public holidays). This delivery is charged at 5.95 € TTC and is offered for any order equal or superior to 60€ (only in Spain). For more information about Mondial Relay : https://www.mondialrelay.fr/

 

Chronopost :

 

Chronopost Pick Up Europe :parcels are delivered to one of the 42,000 pick-up points of the Chronopost network within 3 to 4 days*. This delivery is charged at €9.99 including VAT and is free for all orders over or equal to €150. The parcel will only be given to you with your signature and an ID card. *An estimated delivery time will be indicated before you submit your order. Lamodeuse.com cannot be held responsible for any delay due to force majeure (address error, weather conditions, strike...).

For home deliveries: following an unsuccessful delivery attempt, the transporter (La Poste, Chronopost) is entitled to place your parcel at a post office/pick-up point.

For pick-up point deliveries: if the pick-up point chosen during the validation of your order is not available, the transporter (Mondial Relay, Chronopost) is entitled to place your package in a pick-up point nearby.

Home deliveries are ensured exclusively by Colissimo.

All packages are carefully prepared by Lamodeuse.com team. and the packaging is carefully checked by us before shipment. However, the customer is required to check the package's condition and to refuse it in case it's damaged.

The customer is required to check the received items conformity with his order at delivery. If he notices any damage on the package, he must accept the package with conditions or refuse it and photograph the package and its contents.

 

Any apparent anomaly concerning the delivery such as:

Damaged package,

Missing products,

Deteriorated products,

Non-conforming products to the order,
must be notified within the legal deadlines following the reception of the order either :

The non-respect of the above terms will lead to the impossibility for the customer to claim or obtain compensation.


 

7. RETURN AND REFUND

 

Exchange requests cannot be honored, you will be refunded automatically.

 

Right of withdrawal

According to provisions of article L.121-21 of Consumer Code, the customer has fourteen days from receiving his order to withdraw from this contract.

The customer can withdraw from the contract by sending a written declaration free of any ambiguity to the following address or by email to contact@lamodeuse.com.

It is up to the customer to return his order, as soon as possible and no later than fourteen days following his decision to retract.

Lamodeuse.com grants its customers a period of 30 days from the order's reception to change their mind and return their order with no particular justification.

3. Check items you are returning and the reasons you are returning them.
4. Download and print your return label.

Return conditions

 

Lamodeuse.com is committed to refund the customer the amount of returned items for refund within a legal period of 14 days following the reception of the parcel in our warehouse, provided that following conditions are respected:

 

All returned items must be sent in their original condition and packaging whenever possible, including Lamodeuse.com labels.

 

Regarding shoes, we recommend you to only try them on a carpet or rug to protect their soles. Also, shoes should be returned in the original shoe box and dust covers (if applicable).

Shoe boxes should not be used directly for shipping, they must be packaged.

 

All returned items are inspected in the warehouse.

Lamodeuse.com reserves the right to refuse any refund request if items have been visibly worn/used/damaged. If any of the above instructions have not been followed, we will not be able to refund you and we will have to send it back to you. In this case, you will be charged for the return shipping costs.

 

The customer must keep the package's deposit proof, otherwise, in case of loss, no refund will be issued.

 

Packages returned with postage due will be systematically refused.

Returns involving COD (Cash on Delivery) will not be accepted.

 

Lamodeuse.com cannot be held responsible for returning a competing product and/or a product not sold by Lamodeuse.com. It is the customer's responsibility to return the correct item. In the event it is possible to arrange for the return of your package, we may charge you the corresponding costs.

 

Please note: returns of orders placed on partner sites are the customer's responsibility and must be sent directly to Lamodeuse.com.

 

Refund terms and conditions

 

Refunds are issued within 14 days after receiving the package, directly to the credit card or Paypal account used for the payment of the order. The modalities may differ in case of exceptional commercial operations, they will then be stipulated in the details of the commercial operation.

 

In case the order has been paid in part or in full with a gift card or a voucher, refund will be issued as a voucher usable on your next order.

 

If the customer returns the entire order, the delivery costs will also be refunded, except for Chronopost and Colissimo deliveries. These deliveries correspond to an additional added service, shipping costs will be refunded up to standard delivery costs, that is 5.95€.

 

In case you used a credit card with deferred debit, the refund will also be issued in a deferred payment by your bank.

 

If your order was placed on a partner site, refunds will be issued according to the terms of the partner site.

9. WARRANTY

 

 

All items offered by Lamodeuse.com are subject to the legal guarantee provided by articles L 217-4 and following of the French Consumer Code and/or to the guarantee of hidden defects as defined by articles 1641 and following of the French Civil Code.

 

The Customer has two years to assert one or the other of these guarantees. For the conformity defect, the deadline runs after delivery. For hidden defects, the time limit runs from the discovery of the defect.

 

If the lack of conformity or the hidden defect declared by the customer is assessed and proven, Lamodeuse.com will propose repair, replacement of the item or refund subject to the cost conditions provided for in article L217-9 of the Consumer Code.

 

In case of abnormal or abusive claims, Lamodeuse.com may refuse to process a subsequent order.

 

Lamodeuse.com will not be held responsible for the misuse and/or intensive use of the items by the customer.

 

 

10. MEDIATION

 

 

In case of disputes, the customer can send his complaint directly by email to contact@lamodeuse.com in order to request an amicable settlement.

 

If the amicable attempt to resolve the dispute fails, a request to a mediator must be submitted within one year of the amicable complaint.

 

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Lamodeuse.com adheres to the Service of the E-commerce Mediator of the FEVAD (Federation of E-commerce and Distance Selling) whose coordinates are the following: 60 Rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr. The present general conditions of sale are subject to French law. In case of persistent disagreement on application, interpretation and execution of present conditions, and in absence of amicable agreement, any dispute will be referred to the competent French courts.

 

11. RESPONSIBILITY

 

 

Lamodeuse.com cannot be held responsible for the non-execution or poor execution of the contract concluded in case of an event attributable to the customer, any unforeseeable and insurmountable damage inherent to the use of the Internet network, notably a break in service, an external intrusion or the presence of computer viruses or any other event qualified as force majeure, in accordance with jurisprudence.

 

12. INTELLECTUAL PROPERTY

 

 

All texts, comments, works, illustrations and images reproduced on the site www.lamodeuse.com are reserved under the copyright as well as under the intellectual property and for the whole world. As such and in accordance with the provisions of the code of intellectual property, only the use for private use is authorized, subject to different provisions, even more restrictive of the code of intellectual property. Any total or partial reproduction of the Lamodeuse.com website is strictly forbidden in the absence of prior agreement.

 

13. PERSONAL DATA PROTECTION

 

 

The data collected is exclusively for the use of Lamodeuse.com. It is necessary for processing and managing customer orders as well as for commercial relations between Lamodeuse.com and customers. They also allow Lamodeuse.com to provide customers with personalized services and to improve the relevance of information offered to them.

 

According to January 6, 1978 law, the user has the right to access, rectify, modify and delete data concerning him/her.
